TERMS & CONDITIONS
These terms and conditions will apply to all transactions placed online through the Kittiwake Fine Art Website. Please read carefully before placing any order. All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights.

Orders
We are pleased to accept online order transactions via Stripes secure server using a debit or credit card. All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.
Products, prices and content
Whilst every effort is made to ensure the pictures and colours depicted on the site match as closely as possible those of the actual product, due to technical limitations, some colours may vary.
Prices, product descriptions and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions.
We reserve the right to alter our prices and specifications without notice.
We reserve the right to make minor changes to the products.
Any promotional discount codes are not valid on sales items and gift vouchers. Only one promotional code can be used at any one time.
Description of Products Sold on the Website
We have taken care to describe the products available on this site with accuracy, however, please be aware the colours/grain patterns in the product pictures may vary due to the organic nature of materials the products are created with and the nature of how colours appear on different electronic screens.
Availability
Items will be posted Roal Mail 1st Class (signed for). If a product should become unavailable after your order has been confirmed and paid for, we will refund the price you paid for the product within 30 days following the date of payment. If your order includes products that are temporarily unavailable, we will send the available products out first and will follow with the outstanding items once they are available again. We will refund the shipping fees for the rest of the order. If relevant, we will offer you a replacement for an unavailable product, a product of equal price and quality.
Secure Payment
We currently use Stripe which takes Credit or Debit Card. These payment options use advanced SSL encryption to keep your transaction secure and do not cost you anything to use (we are charged as the seller, you are not charged as the buyer) so you will not pay any extra for your order. You do not need to hold an account with Stripe to use this method of payment.
Delivery
Kittiwake Fine Art does everything in its power to respect the delivery times. Should an event occur which means we are not able to meet our estimated delivery time, we will place a notice on the banner at the top of the website. We cannot be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event. In the event where you do not receive your package, an investigation will be conducted with the carrier and may take several days upon receipt of your claim. During this period of investigation, no reimbursement or re-delivery will take place. Once the package has been located, we will either arrange for a re-delivery or replace this item, if lost by the third party delivery company. We do not take responsibility for items left in a safe place by the delivery company. A request for the goods to be left in a particular place on delivery is at the customer’s own risk. If your order is damaged upon arrival, please send a photo of the damaged item along with your order number to JanetHughes@kittiwakewake.co.uk within 48 hours. We will refund or replace faulty items free of charge so long as we are notified within 48 hours of the customer receiving the item.
The products bought on the Kittiwake Fine Art website will be delivered to one address in mainland UK. For locations outside of UK please contact us. Deliveries outside of the UK may be subject to import taxes and/or additional charges. In this case, the customer is responsible for the charges.
Design, Copyright and Intellectual Property
Kittiwake Fine Art’s products are protected by copyright, design rights, trademark rights and other intellectual property rights, which are owned by Kittiwake Fine Art.
All content available on the Website, including, but not limited to, text, graphics, logos, button icons, images (the “Content”) is the property of Kittiwake Fine Art and is protected by UK and international copyright laws.
The trademarks, logos, and service marks displayed on the Website (collectively, the “Trademarks”) are the registered and unregistered marks of Kittiwake Fine Art and are protected by UK and international trade mark laws.
Refunds & Exchanges
Damaged Items
If your order should arrive damaged, please send a photo of the damage to JanetHughes@kittiwakewake.co.uk within 2 days of receiving the item/s. We will then review and be in touch. If we agree the item is damaged, we will either offer a refund or send a replacement free of charge.
All Other Returns
If you decide to return a product because you have changed your mind you are very welcome to. We offer 30 days from the date you receive your order for a Refund or Exchange.
Please be sure to return your items in the same condition as you received them as we’re unable to refund or exchange items that are returned to us in an unsaleable condition.
Returns can take 7-10 working days to process.
Please note that until we receive the item, we hold no responsibility for the item/s if sent via an untracked postal method.
FAQ’s:
Will I have to pay postage for my return?
Yes, you do have to pay postage on any returns to us, unless an item is faulty or received in error. We are a small business so at the moment we cannot offer free returns.
Can I exchange an item for a different item?
Yes, we are happy to discuss options
What if the item I request to exchange for is out of stock?
If we do not have the item in stock that you ask for in exchange, we will contact you for a second choice but if we cannot reach you we will automatically refund you the full amount.
